Acceptance of Terms

TalkToSoul (“we”, “us”, or “our”) provides personality tests, AI-generated insights, learning resources, and related services (collectively, the “Services”). By creating an account, accessing the Services, or purchasing a plan, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services.

Eligibility and Accounts

• You must be at least 16 years old to use the Services. Users under the age of majority need consent from a parent or legal guardian.
• When you register, you must provide accurate and complete information. Keep your credentials secure and promptly update any changes.
• You are responsible for all activity that occurs under your account. Inform us immediately if you suspect unauthorized access.

Services Overview

TalkToSoul delivers science-backed personality tests (including Big Five, Enneagram, DISC, and color personality tests), AI interpretations, progress tracking, and action plans. We continually improve the Services and may add, modify, or remove features at any time without liability.

License and Permitted Use

• We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Services for individual development or internal team enablement.
• You may download test results for your personal reference but may not resell, sublicense, or publicly distribute our content without written consent.
• Except where explicitly allowed, you may not reverse engineer, scrape, or attempt to extract proprietary datasets or models from the Services.

User Responsibilities

You agree not to:

• use the Services in any unlawful, harmful, or deceptive manner;
• submit test responses that violate intellectual property, privacy, or publicity rights of others;
• interfere with security features or attempt unauthorized access to other accounts;
• exploit AI outputs for harassment, discrimination, or misinformation.

We may suspend or terminate access if we reasonably believe your conduct violates these Terms or threatens the integrity of the platform.

AI Guidance and Limitations

AI-generated interpretations and recommendations are informational only. They are not medical, psychological, legal, or financial advice. Always use your judgment and consult qualified professionals for decisions involving health, safety, or legal obligations. You remain responsible for how you act on any guidance provided by TalkToSoul.

Our tests draw on Big Five, Enneagram, DISC, color personality, and similar self-exploration frameworks and are designed for entertainment or self-exploration only; they are not substitutes for professional psychological diagnosis or treatment.

Paid Plans, Trials, and Billing

• Pricing, plan inclusions, and billing cycles are posted within the Services and may change with notice. Any price changes will apply to subsequent billing periods.
• When you upgrade to a paid plan, you authorize us and our payment processors to charge your selected payment method for recurring fees, taxes, and other charges.
• Unless otherwise stated, subscriptions renew automatically until canceled. You can cancel in your account settings; cancellation takes effect at the end of the current billing period.
• Fees are non-refundable except where required by law or expressly stated in a promotion.

Refund Policy

You may request a full refund within 7 days of your initial purchase if:

• You have not extensively used premium features (e.g., downloaded multiple PDF reports or generated multiple AI deep-analysis reports).
• You experienced a technical issue that prevented you from accessing paid features and our support team was unable to resolve it.

To request a refund, email support@talktosoul.com with your account email address, the date of purchase, and the reason for your refund request. We aim to respond within 3 business days. Approved refunds are processed to the original payment method within 5–10 business days.

Non-refundable situations:

• Requests made more than 7 days after the initial purchase
• Renewals (monthly or yearly) after the first billing cycle — please cancel before the renewal date to avoid charges
• Dissatisfaction with personality test results (our tests are for entertainment and self-exploration; results may vary)

We encourage you to contact us before initiating a chargeback with your bank or payment provider.

Intellectual Property

All software, tests, reports, user interfaces, graphics, and other materials provided by TalkToSoul are owned by us or our licensors and protected by intellectual property laws. You retain ownership of any original content you submit to the Services, but you grant us a worldwide, royalty-free license to use it for operating and improving the Services in accordance with our Privacy Policy.

Third-Party Services

The Services may include integrations or links to third-party platforms (such as analytics dashboards or community channels). Use of those services is governed by the third party’s terms and policies. We are not responsible for third-party content or practices.

Privacy

Our data practices are described in the Privacy Policy. By using the Services, you consent to the collection and use of your information as outlined there.

Suspension and Termination

We may suspend or terminate your account for any violation of these Terms, for non-payment, or when required by law. Upon termination, your license ends and you must stop using the Services. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) remain in effect.

Disclaimer of Warranties

The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of results. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure.

Limitation of Liability

To the fullest extent permitted by law, TalkToSoul and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to your use of the Services. Our aggregate liability for direct damages under these Terms will not exceed the fees you paid to us in the twelve months preceding the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless TalkToSoul, our affiliates, and their officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Services, breach of these Terms, or violation of any law or third-party right.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction where TalkToSoul Inc. is established, without regard to conflict-of-law principles. Any dispute arising out of or relating to the Services will be resolved through good-faith negotiations. If a resolution cannot be reached within 30 days, the dispute will be submitted to binding arbitration in English, with the venue and arbitration rules communicated before proceedings begin. You and TalkToSoul agree to resolve disputes individually and waive the right to participate in class actions.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or in-product notice and update the “Last Updated” date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
